📋ACCEPTANCE OF TERMS

Welcome to TAP[IMAGINE] (accessible at tapimagine.site). These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and TAP[IMAGINE] ("we", "us", "our", "Company") regarding your access to and use of the TAP[IMAGINE] website, mobile applications, AI-powered image generation and editing services, and all related features and functionalities (collectively, the "Service").

By accessing, browsing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any additional guidelines, rules, or disclaimers posted on the Service. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service.

1️⃣DEFINITIONS AND INTERPRETATIONS

For the purposes of these Terms, the following definitions shall apply:

• "Account": A registered user profile created through our authentication system (powered by Supabase) required to access the full features of the Service.
• "AI Models": The artificial intelligence algorithms and systems used by the Service, including but not limited to Google Gemini models (Gemini 2.0 Flash, Nano Banana), and other third-party AI technologies.
• "Dashboard": The user interface where you can manage projects, view generation history, and access account settings.
• "Generated Content": Any images, artwork, or visual content created by the AI Models based on your Input Content and instructions.
• "Input Content": All materials uploaded or provided by you, including Primary Images, Reference Images, Text Prompts, Sketch Drawings, and Lasso Selections.
• "Processing Credits": Units consumed when using AI generation features (if applicable under subscription tiers).
• "Templates": Pre-configured AI prompts and styles available in the Service.
• "Workspace": Your personal editing environment where image manipulation and generation occur.

2️⃣ACCOUNT REGISTRATION AND SECURITY

2.1 Eligibility

• You must be at least 18 years of age to create an Account and use the Service.
• If you are between 13 and 18 years old, you may only use the Service with parental or guardian consent and supervision.
• By registering, you represent and warrant that all information provided is accurate, current, and complete.

2.2 Account Creation

Registration can be completed using:

• Email and password combination
• Google OAuth authentication
• Other third-party authentication providers we may support

You agree to provide accurate registration information and to update it promptly if it changes.

2.3 Account Security

• You are solely responsible for maintaining the confidentiality of your login credentials.
• You must immediately notify us at tapimagine.ai@gmail.com of any unauthorized account access, security breach, or lost credentials.
• We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

2.4 Account Restrictions

• Each individual may maintain only one active Account unless explicitly authorized by us.
• Account sharing is prohibited except for team/enterprise accounts (if available).
• You may not sell, transfer, or assign your Account to any third party.

3️⃣SUBSCRIPTION TIERS AND PAYMENTS

3.1 Available Tiers

• Subscription fees are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law or as explicitly stated in these Terms.
• We accept payments via credit card, debit card, and other methods as displayed on the Service.
• You authorize us to charge your payment method for all applicable fees.

3.3 Modifications and Cancellations

• You may upgrade, downgrade, or cancel your subscription at any time through your Account settings.
• Changes take effect at the next billing cycle.
• No partial refunds will be provided for downgrades or cancellations.

4️⃣USE OF THE SERVICE

4.1 Permitted Uses

You may use the Service to:

• Generate and edit images for personal, educational, or commercial purposes (subject to your subscription tier)
• Create derivative works from your own original content
• Experiment with AI-powered creative tools
• Share and export your Generated Content
• Collaborate with team members (if applicable to your subscription)

4.2 Prohibited Uses

You expressly agree NOT to:

• We employ automated and manual content moderation systems.
• Content violating these Terms may be removed without notice.
• Repeated violations may result in account suspension or termination.

5️⃣INTELLECTUAL PROPERTY RIGHTS

5.1 Your Input Content

You retain all ownership rights to Input Content you upload. By uploading Input Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to process, analyze, store, backup, display, and generate AI outputs based on your content. This license terminates when you delete your content, except for content already used in anonymized training data.

5.2 Generated Content Ownership

Subject to your compliance with these Terms, you own the Generated Content you create. We grant you a license to use Generated Content based on your subscription tier:

• Free Tier: Personal, non-commercial use only
• Paid Tiers: Commercial use permitted

You acknowledge that similar prompts may produce similar outputs for different users, and AI-generated content may not be eligible for copyright protection in all jurisdictions.

5.3 Our Intellectual Property

The Service, including its design, features, algorithms, and documentation, is protected by intellectual property laws. "TAP[IMAGINE]" and associated logos are our trademarks. You may not use our intellectual property without express written permission.

10️⃣DISPUTE RESOLUTION

10.1 Governing Law

These Terms are governed by the laws of India, specifically the state of Bihar, without regard to conflict of law principles.

10.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India, conducted in Patna, Bihar.

10.3 Jurisdiction

For matters not subject to arbitration, you consent to the exclusive jurisdiction of the courts in Patna, Bihar.
